Fake Doctor Facing 36 Years in Prison

San Francisco man posed as a physician assistant and performed plastic surgery.

A jury has convicted Carlos Guzmangarza, of San Francisco, of 33 felonies and eight misdemeanors after he posed as a physician assistant and performed plastic surgery on numerous victims.

Guzmangarza faces up to 36 years in prison and is next slated to be in court on October 30, 2015, when a judge will schedule his sentencing date.

The Department of Consumer Affairs’ Division of Investigation learned that from 2008 to 2011, Guzmangarza owned and operated Derma Clinic, a plastic surgery clinic located on Mission Street in San Francisco.

Guzmangarza, who is not licensed, impersonated a physician assistant and told patients that the clinic was operated by a doctor.  He then performed surgical procedures including liposuction, facelifts and buttock augmentations on patients.  The real physician and physician assistant had no knowledge that Guzmangarza was using their names and they were not affiliated with his clinic.

Investigators from the Division’s Health Quality Investigations Unit San Jose Field Office and the San Francisco District Attorney’s Office located numerous victims of Guzmangaraza’s practice.  Nine victims testified at the trial.

One victim stated that during her liposuction surgery, Guzmangarza was smoking a cigar and she had to hold up her own IV bag.  She also stated that the suite the liposuction was performed in lacked running water.  A few days after the procedure, Guzmangarza showed up at her house in order to flush the liposuction fat down her toilet.  This victim later developed an infection and had to have corrective surgery.

Guzmangarza was initially charged with 54 counts including rape, forced oral copulation, sexual battery, practicing without a license, identity theft, grand theft and false impersonation.  At the conclusion of the trial, 51 charges were submitted to the jury and Guzmangarza was found guilty of 41.  The jury did not find Guzmangarza guilty of the rape and oral copulation charges.
